United States commences trade investigation on Aluminium Extrusions from Malaysia and 14 other countries - Lexology

On 4 October 2023, the United States (“US”) Department of Commerce (“DOC”) and the US International Trade Commission initiated an anti-dumping duties investigation on aluminium extrusions allegedly dumped from Malaysia, Colombia, the Dominican Republic, Ecuador, India, Indonesia, Italy, Mexico, the People’s Republic of China, South Korea, Taiwan, Thailand, Turkey, the United Arab Emirates and Vietnam (“Subject Countries”). The anti-dumping measure was sought by the US Aluminium Extruders Coalition and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union (“Petitioners”).

The Petitioners have alleged that the aluminium extrusions imported from the Subject Countries are being, or are likely to be, sold at less than normal value in the US. The Petitioners further alleged that these alleged unfairly traded aluminium extrusion imports from the Subject Countries have been increasing for years and have taken a significant share of the US market from domestic producers. The official import statistics show that these imports increased by 41% from 2019 to 2022 which took 6% of the market share directly from domestic producers.

The Petitioners have alleged that the Malaysian producers have posed a threat to the US domestic industry because the Malaysian producers prioritise the US as their favoured export market. The Petitioners have further alleged that the Malaysian producers, who are oriented toward exports, have substantial and growing production capabilities, and the Malaysian producers will direct that capacity to the US market in the absence of relief.

The Petitioners are seeking for the DOC to impose anti-dumping duties ranging from 33.79% to 256.58% on imports of aluminium extrusions from the Subject Countries. Specifically, the anti-dumping duties sought to be imposed against Malaysian producers are 53.91%.
